These general promo terms (the ‘General Promo Terms’) are the terms and conditions that apply to Promotions.
PokerStars is the ‘promoter’ of all Promotions, which means that PokerStars is responsible for operating all Promotions.
We’ve divided the General Promo Terms into the following Sections:
To be eligible to participate in a Promotion:
(a) you must satisfy the Account Requirements and otherwise comply with the General Terms;
(b) you must satisfy the Promotion Specific Eligibility Requirements set out in the Key Terms for that Promotion;
(c) you must not be excluded or self-excluded from the Website or from any specific Games or parts of the Services that Entrants are required to play or use to participate in the Promotion;
(d) you must not have been disqualified from participating in Promotions, whether under Part B Section 9.2 (c) of the General Promo Terms or by any similar provision contained in other Flutter Group terms and conditions (whether or not those terms and conditions are still in existence); and
(e) the name you use to participate in the Promotion must match the name on your Account and you cannot enter a Promotion as part of a syndicate or on behalf of any other person or entity.
In addition, without affecting the Account Requirements or anything we say in the General Terms, to be eligible to participate in a Prize Promotion you must not fall within any of the following categories of people:
(a) employees of any company in Flutter Group;
(b) employees of any third parties who are professionally connected with the Prize Promotion; and
(c) members of the immediate families and households of employees who fall into the categories described in (a) and (b);
The eligibility requirements set out in Part A Sections 1.1 and 1.2 above are the ‘General Eligibility Requirements’.
By participating in a Promotion you confirm and promise that:
(a) you meet the General Eligibility Requirements at the time you enter the Promotion;
(b) you will continue to meet the General Eligibility Requirements whilst you are participating in the Promotion (including whilst you are fulfilling any Prize or Bonus); and
(c) you will promptly tell us if you stop meeting any of the General Eligibility Requirements for any reason before your participation in the Promotion (including the fulfilment of any Prize or Bonus) ends.
So that we can check that you meet the General Eligibility Requirements, we may from time to time (including during and/or at any time after the Promotion) ask you to comply with Verification Requests. This could include providing personal details and copies of documentation such as your passport, driving license, other government-issued photo ID, utility bills and/or bank statements, attending phone or video calls, and/or recording playing sessions.
All information collected about you in connection with your participation in a Promotion will only be used in accordance with the Website’s privacy policy and for the following purposes (as relevant depending on the type of Promotion): to administer and promote the Promotion (including publishing Entrants’ usernames and geographical locations on leaderboards), to select Winners of Prize Promotions, to contact Winners and Bonus Recipients about their Prize or Bonus, to arrange delivery and fulfilment of a Prize or Bonus, to announce Winners of Prize Promotions and to make the details of Winners of Prize Promotions available in accordance with Part A Section 2.2 of the General Promo Terms. When you choose to participate in a Promotion, you agree to us using your information for these purposes.
We may publish the name, username and/or geographical location of Winners of Prize Promotions on the Website and the Social Media Account(s). We may also publish any comments that a Winner may have made in relation to the Prize Promotion and/or their Prize. In addition, we may be legally required to provide the name and geographical location of Winners of a Prize Promotion to third parties, including governmental authorities, upon request.
If you have questions about a Promotion, please contact us giving details of the Promotion and your question(s).
We will amend, cancel, suspend or re-start a Promotion, in whole or in part, if any Event Beyond Our Control makes it necessary to do so (including to comply with applicable law).
We may change the General Promo Terms and/or the Key Terms for a Promotion at any time, for example to correct information, reflect changes to the Promotion, or to comply with applicable law or a change in our regulatory requirements. If you are participating in a Promotion, we encourage you to visit the Website regularly to check the version of the General Promo Terms and the Key Terms for that Promotion in force at that time.
In addition, we may at any time withdraw the availability of a Promotional Offer to you. Unless you have been disqualified in accordance with Part B Section 9 of the General Promo Terms, you will be entitled to retain any Bonus to which you were entitled before we withdrew the availability of the Promotional Offer to you, together with any winnings you may have received from claiming/redeeming such Bonus.
When we say ‘Promotion’ in the General Promo Terms, we mean promotions that are made available to Users by PokerStars.
At times, promotions may be promoted on or accessible through the Website and/or Social Media Account(s) that are operated by third parties (i.e. persons other than PokerStars) (‘Third Party Promotions’). Third Party Promotions are not ‘Promotions’ as defined in the General Promo Terms and we are not responsible for operating Third Party Promotions. The General Promo Terms do not apply to Third Party Promotions, and instead the terms and conditions of the third party who is operating the Third Party Promotion will apply.
There may also be prize promotions that are promoted on or accessible through the Website and/or Social Media Account(s) that are made available to individuals who are not Users as well as to Users. Such promotions are not ‘Promotions’ as defined in the General Promo Terms (even if another company in Flutter Group is responsible for operating such promotions). The General Promo Terms do not apply to such promotions, and instead such promotions will have their own bespoke terms and conditions that will apply.
We can’t promise that there will be no Errors, Malfunctions or Interruptions (which in the context of the General Promo Terms includes those relating to the Social Media Account(s) as well as the Services) whilst you are participating in a Promotion (including whilst you are fulfilling any Prize or Bonus). Like the Services, the Social Media Account(s) may be suspended temporarily and without notice for maintenance or repair or due to any Event Beyond Our control.
It’s important that we receive your Entry during the Entry Period, otherwise it will be invalid and won’t be eligible for a Prize or Bonus. Proof of sending does not mean that we have received an Entry.
If there is a discrepancy between the time of your Entry (or of any other time-sensitive action in relation to the Promotion) as displayed on your device and the time of your Entry (or of any other time-sensitive action in relation to the Promotion) as displayed on our records on our server or on the Social Media Account(s), our records will prevail.
It’s important that you read the Entry Instructions very carefully, as they explain exactly what you need to do to participate in the Promotion and when you need to do it, what format your Entry must be in and what information must be included in your Entry. Entries that don’t fully comply with the Entry Instructions will be invalid and won’t be eligible for a Prize or Bonus.
If we’re unable to view, read or hear your Entry (as applicable), whether that is due to an Error, Malfunction or Interruption (please refer to Part B Section 2.1 of the General Promo Terms to see what we mean by ‘Error, Malfunction or Interruption’ in the General Promo Terms), or for any other reason, it will be invalid and won’t be eligible for a Prize or Bonus.
Once you’ve submitted an Entry, it can’t be revoked or amended by you, unless we say otherwise in Part A of the General Promo Terms.
If there is a restriction on the number of times you can enter a Promotion, the Entry Instructions will specify the maximum number of Entries you can submit. If you attempt to submit more Entries than are allowed, we will only count the first one(s) chronologically and the subsequent Entries will be invalid and won’t be eligible for a Prize or Bonus.
Entries that contain Unauthorised Content will be invalid and won’t be eligible for a Prize or Bonus.
Our selection of Winner(s) and determination of Bonus Recipients is final and binding, provided we make our selections and determinations in accordance with the Key Terms.
All Entries to a Prize Promotion that are not invalid will be pooled and the Winner(s) will then be selected from that pool in accordance with the Winner Selection Method.
When the original Winner of a Prize is disqualified from a Prize Promotion, we will (unless the Key Terms say otherwise) select an alternative Winner using the same Winner Selection Method that we used to select the original Winner (with the original Winner’s Entry(ies) removed from the pool of eligible Entries).
If you’re incorrectly selected as a Winner or Bonus Recipient and are awarded a Prize or Bonus due to an Error, Malfunction or Interruption (please refer to Part B Section 2.1 of the General Promo Terms to see what we mean by ‘Error, Malfunction or Interruption’ in the General Promo Terms), we can reclaim from your Account where applicable, or you must otherwise return to us, the Prize or Bonus together with any winnings you may have received from claiming/redeeming the Prize or Bonus.
Unless the Key Terms say otherwise, there is a limit of one Prize per family or household per Prize Promotion. This means that if a family/household wins more than one Prize in a Prize Promotion, we will only count the first Prize won chronologically and the subsequent Prizes will be forfeited.
Prizes and Bonuses do not include any costs, taxes, fees, expenses, items and/or arrangements not expressly set out in the Prize Description or Bonus Description (‘Exclusions’). Winners and Bonus Recipients will be solely responsible for all Exclusions and we won’t be responsible to Winners and Bonus Recipients for any costs they incur in connection with their Prize or Bonus.
Sometimes a Prize or Bonus, or part of a Prize or Bonus, may become unavailable for some reason, and when this happens we will (if we’re reasonably able to do so) substitute the unavailable Prize or Bonus (or the part of the Prize or Bonus that is unavailable) with another prize or bonus that we reasonably consider to be of at least the same value.
Unless we are required to do so under applicable law, we will not provide cash or any other alternative for any Prize or Bonus or any part of a Prize or Bonus (including when a Winner or Bonus Recipient does not, or is unable to, fulfil their Prize or Bonus through no fault on our part).
Winners and Bonus Recipients may not give away, exchange with third parties (i.e. persons other than PokerStars) and/or sell, or attempt to give away, exchange with third parties and/or sell, any Prize or Bonus, or any part of a Prize or Bonus (including any part of a Prize that is available to a companion of the Winner).
If a Winner does not, or is unable to, fulfil their Prize through no fault on our part, we will be entitled to select an alternative winner of the Prize.
When the Prize offered in a Prize Promotion is an Experience Prize, additional provisions apply which are set out in Part B Section 10 of the General Promo Terms.
We’ll let you know if you’ve been awarded a Prize or Bonus using the notification method set out in the Key Terms and within timelines set out in the Key Terms. It’s your responsibility to ensure that you can be contacted by the notification method set out in the Key Terms, and to let us know if your contact details change during a Promotion, and we won’t be responsible if we’re unable to contact you.
If the Key Terms state that Winners or Bonus Recipients must respond to us or take any other action to accept their Prize or Bonus, it’s the responsibility of the Winner or Bonus Recipient to do so in the manner and within the timelines set out in the Key Terms or within any other reasonable timeline that we communicate to you.
Prizes will be issued in the name of, and delivered to, the Winner only and Bonuses will be issued in the name of, and delivered to, the Bonus Recipient only.
Where a Prize is to be physically delivered to the Winner, the Winner is responsible for providing to us a delivery address within their country of residence.
We don’t provide tax advice to Winners and Bonus Recipients and it’s the responsibility of Winners and Bonus Recipients to determine whether tax is payable on their Prize or Bonus and, if tax is payable, to make correct and timely payment to the relevant authority.
We will withhold tax from the Prize or Bonus if we are required to do so to comply with applicable law.
The estimated Prize value for tax purposes may be stated in the Key Terms for a Prize Promotion, but if it’s not and the Winner requires this information for tax purposes, they should contact us giving details of the Prize Promotion and the Prize for which they require the estimated Prize value. If an estimated Prize value is stated in the Key Terms, this will be our reasonable estimate at the time the Key Terms are posted and we can’t promise that there won’t be any subsequent fluctuations in the Prize value.
Where you choose to participate in a Prize Promotion where the Entry Instructions require you to submit an Entry that contains copyright material (for example, a photograph, a video or an original piece of writing (including social media posts)):
(a) you will retain the copyright in your Entry;
(b) you grant us, for the benefit of Flutter Group, a worldwide, irrevocable, transferable, royalty free, sublicensable license to use your Entry for any purpose connected with the Promotion and the Services;
(c) you confirm and promise that your Entry doesn’t contain any Unauthorised Content, which includes a promise that:
If the Entry Instructions for a Prize Promotion require you to send us a hard copy of your Entry, we can’t promise to return it to you.
Entrants to Prize Promotions may be selected by us to participate in publicity activity. When you choose to participate in a Prize Promotion, you promise to participate in and cooperate with us in connection with all publicity activity reasonably requested by us in connection with that Prize Promotion, the Prize, the Services and/or Flutter Group.
Flutter Group owns the copyright in any publicity materials in which you (including your image and voice), your details and/or your Entry appear and, when you participate in any publicity activity in accordance with Part B Section 7.1 above, you confirm and promise that we can use, copy, modify, distribute and publish the publicity materials however we choose and for any purpose connected with the Promotion and the Services, without having to pay you or obtain any additional permission from you.
As set out in Part B Section 21.1 of the General Terms, there are certain circumstances where our liability is never excluded. That also applies to the General Promo Terms.
Without affecting anything we say in Part B Section 8.1 above, we won’t be responsible to you in the following circumstances:
(a) where we’ve stated in the General Terms that we won’t be responsible to you;
(b) where you’re not able to participate or participate fully in a Promotion, Prize or Bonus due to an Error, Malfunction or Interruption (please refer to Part B Section 2.1 of the General Promo Terms to see what we mean by ‘Error, Malfunction or Interruption’ in the General Promo Terms);
(c) where we’ve stated in the General Promo Terms and/or the Key Terms for a Promotion that something is your responsibility;
(d) where we’ve stated in the General Promo Terms and/or the Key Terms for a Promotion that something can’t be promised by us;
(e) where we’ve stated in in the General Promo Terms and/or the Key Terms for a Promotion that an Entry will be invalid;
(f) where tickets, vouchers, pre-paid cards, gift cards, certificates and/or other documentation connected with a Prize or a Bonus are lost, stolen, damaged or subject to fraudulent activity following delivery to you;
(g) where any loss, theft, damage or injury caused or sustained by you whilst participating in a Promotion, Prize or Bonus occurs;
(h) where we’re required to take action in relation to a Promotion, Prize and/or Bonus due to any Event Beyond our Control (including to comply with applicable law);
(i) where there’s any postponement, cancellation, delay or changes connected with the Promotion or the fulfilment of a Prize or Bonus due to any Events Beyond our Control (including to comply with applicable law);
(j) where you’re incorrectly awarded a Prize or Bonus due to an Error, Malfunction or Interruption (please refer to Part B Section 2.1 of the General Promo Terms to see what we mean by ‘Error, Malfunction or Interruption’ in the General Promo Terms);
(k) where you’re not able to fulfil the Prize or Bonus through no fault on our part;
(l) if you’re not satisfied with your Prize or Bonus (provided it complies with the applicable Prize Description or Bonus Description); and
(m) where we disqualify you from a Promotion in accordance with Part B Section 9 of the General Promo Terms.
Nothing in this Part B Section 8 affects anything we say elsewhere in the General Terms about our liability or responsibility to each other (for example in Part B Sections 20 and Part B Section 21 of the General Terms).
We will disqualify you from a Promotion in the following circumstances:
(a) if you haven’t satisfied the General Eligibility Requirements, or if you stop meeting any of the General Eligibility Requirements whilst you are participating in the Promotion (including whilst you are fulfilling any Prize or Bonus);
(b) if we discover or have reason to believe that you have taken part in a Prohibited Event (which in the context of the General Promo Terms includes events and practices relating to the Social Media Account(s) in addition to the Services);
(c) if we’re unable to contact you in relation to a Promotion through no fault on our part, or if you don’t respond to our communications about a Promotion, Prize or Bonus within the timelines set out in the Key Terms or within any other reasonable timeline that we communicate to you;
(d) if you fail to co-operate fully with our reasonable requests for information or for action on your part that we reasonably consider to be necessary to enable fulfilment of a Prize or Bonus (for example, a request for you to provide a delivery address for a Prize in your country of residence, to provide passport details to us by a certain time so that we can book a flight as part of a Prize or to sign a waiver in relation to an Experience Prize);
(e) if we discover or have reason to believe that you have participated in a Promotion, alone or with others, to guarantee profit regardless of outcome;
(f) if we discover or have reason to believe that, in connection with any aspect of your participation in the Promotion (including whilst you are fulfilling any Prize or Bonus), you have (whether intentionally or unintentionally) engaged in conduct that is damaging to the image or reputation of Flutter Group, its commercial partners and/or its/their businesses and brands;
(g) if we discover or have reason to believe that you are not fit to participate in an Experience Prize or that your participation in an Experience Prize will cause risk to you or others;
(h) if your Entry contains Unauthorised Content;
(i) if we have said in Part A of the General Promo Terms that you will be disqualified in certain circumstances and those circumstances have arisen; and/or
(j) where we are required to do so to comply with applicable law.
When we disqualify you from a Promotion:
(a) you will no longer be eligible to participate in the Promotion and all your Entries for the Promotion will be invalid and won’t be eligible for a Prize or Bonus;
(b) if we consider it reasonable (taking into account the reasons we have disqualified you from a Promotion), we may disqualify you from any other Promotions you are participating in and, if we do so, all your Entries for those Promotions will be invalid and won’t be eligible for Prizes or Bonuses; and
(c) if we consider it reasonable (taking into account the reasons we have disqualified you from a Promotion), we may exclude you from participating in future Promotions.
When we disqualify you from a Promotion after you’ve been awarded a Prize or Bonus:
(a) your entitlement to receive the Prize or Bonus will be revoked;
(b) we can reclaim from your Account where applicable, or you must otherwise return to us, the Prize or Bonus together with any winnings you may have received from claiming/redeeming the Prize or Bonus; and
(c) in the case of Prize Promotions, we will be entitled to select an alternative winner of the Prize originally awarded to you.
The following provisions apply when the Prize offered in a Prize Promotion is an Experience Prize:
Where the Prize Description specifies the Experience Prize date(s), venue(s) and/or destination(s), no alternative date(s), venue(s) and/or destination(s) will be available.
Where the Prize Description states that the Winner has the option of selecting the Experience Prize date(s), venue(s) and/or destination(s), any deadlines for redemption and blackout periods (i.e. periods during which an Experience Prize may not be taken) set out in the Key Terms will apply. The Winner must provide their preferred options to us within any reasonable timelines we stipulate and we can’t promise that the Winner’s preferred options will be available. If the Winner’s preferred options aren’t available, the Winner will be required to accept alternative options that are available. Once the date(s), venue(s) and/or destination(s) for an Experience Prize have been accepted and booked, they can’t be revoked or amended by the Winner.
Where the Prize Description allows the Winner of an Experience Prize to be accompanied by a companion, the Winner’s companion must be at least the minimum age required to participate in the Prize Promotion (as set out in the General Eligibility Requirements).
Only the elements of the Experience Prize that the Prize Description states are available to the companion as well as to the Winner will be made available to the Winner’s companion.
Any requirements and obligations relating to the fulfilment of the Experience Prize set out in the General Promo Terms and the Key Terms for the Promotion that apply to the Winner will also apply the Winner’s companion.
The Winner and their companion must attend the activities and/or events included in the Experience Prize together (unless the Prize Description states that a particular activity or event is available to the Winner only) and must travel together where the Prize Description states that travel for the Winner and their companion is provided by us.
By entering a Prize Promotion with an Experience Prize, you confirm and promise that you are in good health, are fit to participate in the Experience Prize and that you’re not aware of any circumstances (including any medical conditions and disabilities) that could place you at any medical, security, safety or other risk if you participate in the Experience Prize.
It’s the responsibility of the Winner of an Experience Prize to tell us immediately if they become unwell or become aware of any other relevant medical or health and safety information that could make their participation in the Experience Prize unsafe for them or others.
The Winner of an Experience Prize may be asked by us to sign a waiver(s) and/or provide a medical certificate and/or other documentation or information confirming that they are fit to participate in the Experience Prize. It’s the Winner’s responsibility to sign any waiver(s) and provide any documentation and information we ask for within any timelines set out in the Key Terms or within any other reasonable timeline that we communicate and the Winner confirms and promises that all documentation and information they provide to us will be true, complete and accurate.
It’s the responsibility of the Winner of an Experience Prize to comply with all health and safety requests made by us, our representatives and any third party involved in the fulfilment of the Experience Prize.
It’s the responsibility of the Winner of an Experience Prize to check and comply with any terms, conditions, restrictions, requirements, instructions, rules, regulations and policies of any third party involved in the fulfilment of the Experience Prize (including those set out on any tickets relating to the Experience Prize and those of airlines, hotels and event venues connected with fulfilment of the Experience Prize).
Where the Prize Description states the Experience Prize includes a ‘meet and greet’ element, the ‘meet and greet’ element is subject to the availability of the celebrity/personality in question and can’t be promised by us.
Where the Prize Description states the Experience Prize includes a travel element:
(a) flights can only be arranged from the Winner’s country of residence;
(b) it’s the Winner’s responsibility to check and ensure that they satisfy all customs, security and immigration requirements for travel (including all requirements relating passports, visas and other documentation);
(c) it’s the Winner’s responsibility to check any government travel advisories relating to the travel destination and to determine what action to take in relation to any such advisories;
(d) it’s the Winner’s responsibility to check whether any vaccinations and/or prescription medicines are recommended or required prior to travel and to determine what action to take in relation to any recommendations;
(e) it’s the Winner’s responsibility to take out their own travel insurance and to comply with the terms and conditions of their travel insurance policy; and
(f) it’s the Winner’s responsibility to pay for any additional costs or expenses that arise in connection with a cancellation/delay to flights or other form of transport.
The following capitalised words and phrases have the following meanings in the General Promo Terms:
Bonus: A free stake, free bet or other bonus made available to some or all Users upon the completion of certain actions as part of a Promotional Offer.
Bonus Description: The description of a Bonus, as set out in the Key Terms for a Promotional Offer.
Bonus Recipient: A User who has successfully completed the actions required to claim a Bonus in a Promotional Offer.
Entrant: A User who chooses to participate in a Promotion.
Entry: An Entrant’s entry to a Promotion.
Entry Instructions: The instructions on how to enter a Promotion, as set out in the Key Terms for that Promotion.
Entry Period: The period during which you may enter a Promotion, as set out in the Key Terms for that Promotion.
Exclusions: As defined in Part B Section 5.1 of the General Promo Terms.
Experience Prize: A Prize that consists of, or includes, the Winner attending an event or taking part in an experience (such as a trip).
General Eligibility Requirements: All the requirements you must satisfy to be eligible to participate in a Promotion, as set out in Part A Sections 1.1 and 1.2 of the General Promo Terms.
Key Terms: The bespoke terms that apply to each individual Promotion in addition to the General Promo Terms, as displayed on the Website, Gaming Platform, Social Media Account(s) or other communication (such as email).
Prize: A prize to be awarded to a Winner of a Prize Promotion.
Prize Description: The description of a Prize, as set out in the Key Terms for a Prize Promotion.
Prize Promotion: A promotion made available by us to some or all Users where a Winner(s) is/are selected by us to win a Prize.
Promotion: A Promotional Offer or Prize Promotion. Part B Section 1 of the General Promo Terms explains in more detail what we mean when we say ‘Promotion’ in the General Promo Terms. For avoidance of doubt, a Promotion forms part of the Services for the purposes of the General Terms.
Promotional Offer: An offer made available by us to some or all Users to acquire Bonuses upon the fulfilment of certain actions.
Promotion Specific Eligibility Requirements: The requirements you must satisfy to be eligible to participate in a Promotion that are specific to, and set out in the Key Terms for, that Promotion.
Third Party Promotion: As defined in Part B Section 1.2 of the General Promo Terms.
Winner: A person selected by us to win a Prize in a Prize Promotion.
Winner Selection Method: The method used by us to select a Winner, as set out in the Key Terms for a Prize Promotion.
